1. General Provisions

These Terms of Use govern the use of the PsyBank platform ("Platform") operated by Psikonet Yayıncılık ve Eğitim Anonim Şirketi ("Company").

Any natural or legal person who accesses, uses, or registers on the Platform is deemed to have read, understood, and accepted all provisions of these Terms of Use. Persons who do not accept these terms should not use the Platform.

2. Definitions

The terms used in these Terms of Use have the following meanings:

• Platform: The web application accessed through the psybank.com domain, operated by the Company.
• Therapist: A psychologist, psychiatrist, or psychological counselor who uses the Platform to provide professional services.
• Client: A person registered on the Platform through a Therapist and receiving services through the Platform.
• Services: All services provided through the Platform, including online therapy, psychological assessment and scale administration, client management, and similar services.

3. Membership and Account Security

Users who wish to register as therapists must possess valid professional competency certificates (diploma, license, specialty certificate, etc.) in accordance with applicable regulations. The Company reserves the right to evaluate therapist applications and reject applications it deems unsuitable.

Users are responsible for maintaining the confidentiality of their account information (username, password, etc.). The account holder is responsible for all transactions performed using their account credentials.

Sharing account information with third parties, unauthorized access or attempted access to others' accounts is strictly prohibited. Upon detection of such situations, the Company reserves the right to suspend or permanently close the relevant account.

4. Terms of Service Use

The content, quality, and outcomes of therapy, psychological assessment, and counseling services provided through the Platform are entirely the professional responsibility of the relevant therapist. The Company serves as a technology provider and intermediary in the professional relationship between the therapist and client.

Therapists are obligated to comply with professional ethical rules and applicable regulations in the services they provide through the Platform.

Important Warning: The Platform is not suitable for situations requiring emergency medical intervention. In case of suicidal ideation, risk of harm to oneself or others, or any emergency health situation, you must immediately call 112 Emergency Services or contact the nearest healthcare facility.

5. Intellectual Property Rights

The design, software, source code, database, logos, graphics, texts, and all content of the Platform are the exclusive property of the Company and are protected under national and international intellectual property legislation.

Without the prior written consent of the Company, copying, reproducing, distributing, processing, publishing, reverse engineering, or using any part or content of the Platform in another medium is strictly prohibited.

6. Privacy and Personal Data

Detailed information regarding the collection, processing, storage, and transfer of personal data belonging to users is provided in the Privacy & Data Protection Notice published separately on the Platform.

Health data belonging to clients is considered sensitive personal data under GDPR and applicable data protection regulations and is protected with appropriate security measures.

All data is transmitted through encrypted connections, stored with industry-standard security protocols, and protected against unauthorized access.

7. Payment and Subscription

Subscription fees for therapists are collected according to the plans and tariffs specified on the Platform. Current subscription plans and fees can be viewed on the Platform.

All payments are processed through a secure payment infrastructure. The Company does not directly store payment information; payment transactions are conducted through licensed payment institutions.

Cancellation and refund conditions are determined according to the user's subscription plan. Cancellation requests are effective until the end of the relevant billing period, and service fees incurred up to the cancellation date are non-refundable.

8. Limitation of Liability

The Company cannot be held responsible for the content, accuracy, or results of therapy and counseling services provided by therapists through the Platform.

The Company exercises maximum care regarding access interruptions caused by technical issues, maintenance work, infrastructure updates, or force majeure events; however, no guarantee of uninterrupted service is provided.

The Platform is provided "as is," and the Company makes no express or implied warranty regarding the Platform's fitness for any particular purpose of the user.

9. Amendments

The Company reserves the right to amend, update, or repeal these Terms of Use at any time without prior notice.

Amendments take effect on the date they are published on the Platform. Users who continue to use the Platform after amendments are deemed to have accepted the updated terms.

10. Dispute Resolution

These Terms of Use are subject to and shall be interpreted in accordance with the laws of the Republic of Turkey.

Istanbul Courts and Enforcement Offices have exclusive jurisdiction in resolving any disputes arising from these terms.
